Patents are a tool for the government to protect innovation, but patents are not an absolute safeguard against invention.

In fact, a recent patent filing by Google illustrates just how difficult it is for the Patent Office to stop patents being issued.

The patent filing was filed in the year 2020 and states that “the invention is not subject to patentability in the United States.”

The filing comes at a time when there is a significant push in Congress to extend the patents granted to companies to make their products more secure.

“We have been working with the U.S. Patent and Trademark Office and other agencies in the Federal Government to extend their patent term for a few years now, and we’re hoping to be able to do the same for the next couple of years,” John Moline, vice president of public policy at Google, told Fortune.

The filing in the patent portfolio is actually a little more than a footnote in Google’s patent application, and it is not clear how much of the patent has expired.

A recent patent application for the use of a “secure and modular communication layer” that is “based on secure, secure communication protocols.”

This is the term that Google has used in its patent filing for years.

Patent Office officials do not seem to be aware of the term in any patent filing and have yet to confirm whether the term has expired or not.
